Objection to the Payment Order: Time Limits, Formalities and Legal Consequences

The debtor's seven-day right to object

How is an objection to a payment order filed, what is the time limit, and when does it stay enforcement? Objection to the debt, objection to the signature, and late objection in practice.

This article concerns the payment order in ordinary non-judgment attachment proceedings. Under İİK m.62 an objection is lodged with the enforcement office within seven days of service and a timely objection stays proceedings. In negotiable-instrument proceedings, most objections instead go to the enforcement court within five days and have a different effect. First identify the type of order received.

Time Limit and Form of Objection

Under İİK m.62, the debtor must notify the enforcement office of the objection within seven days from service of the payment order. The period is calculated from the day following service and is a forfeiture period. The objection may be filed in writing or orally; oral objections are recorded in the minutes.

The debtor may object to all or part of the debt, and also to the signature on the underlying deed. A signature objection must be raised separately and explicitly; otherwise the signature is deemed acknowledged (İİK m.62/5).

Effect of the Objection on the Proceedings

A timely objection automatically stays the proceedings. To continue, the creditor must seek removal of the objection by the enforcement court (İİK m.68 et seq.) or bring an action for annulment of objection in the ordinary courts (İİK m.67). The objection only operates in favour of the objecting debtor; the objection of one joint and several debtor does not affect the others.

Late Objection

A debtor prevented without fault from objecting may seek a late objection within three days after the obstacle ends and before realisation is completed (İİK m.65). Applying does not itself stay enforcement. Defective service is a separate issue: Article 32 of the Service Act concerns the date of actual knowledge, and correction of the service date may require a complaint. It should not automatically be treated as a ground for late objection.

If the late objection is accepted, the proceedings are stayed and the creditor must still overcome the objection under the general rules.

Practical Considerations

In enforcement and bankruptcy proceedings, the choice of enforcement track must be determined by the basis of the claim and the available documents. Although ordinary enforcement, commercial-paper enforcement, judgment-based enforcement, preliminary attachment, composition with creditors and bankruptcy may pursue the same outcome, they differ in time limits, available objections and costs.

Dates of service, objection or payment deadlines, attachment requests, sale-request periods and complaint deadlines are the most critical stages of the file. For this reason the dates of service of the payment order, enforcement order, attachment record, valuation report and sale notice should be tracked in a separate schedule.

For the creditor, interest calculation, the clarity of the enforcement request and the inquiry into the debtor's assets are decisive; for the debtor, grounds of objection, claims of exempt assets and the possibility of a negative declaratory action must be assessed from the outset. Otherwise, a procedural oversight may eclipse a meritorious position.

Conclusion

Objection to the payment order is one of the debtor's primary defences at the initial stage. The seven-day period must not be missed, and the scope of the objection — particularly any signature objection — must be stated explicitly.
