Enforcement and Bankruptcy Law
This section covers debt collection, attachment, composition with creditors (concordato) and bankruptcy proceedings. The articles are prepared in light of the current provisions of the Enforcement and Bankruptcy Code (No. 2004) and the settled case law of the 12th Civil Chamber of the Court of Cassation.
Initiating Enforcement Proceedings: Enforcement With and Without a Judgment
Methods for collecting a claim through compulsory enforcement
How are enforcement proceedings started? Differences between enforcement with a judgment and without a judgment, the request, payment order and attachment.
The core aim of compulsory enforcement law is to ensure that a creditor's monetary claim is satisfied securely through state authority. The Enforcement and Bankruptcy Code (İİK) provides two main routes: enforcement based on a judgment (ilamlı takip) and enforcement initiated directly before the enforcement office without a judgment (ilamsız takip). The choice depends on the legal nature of the claim and the documents available.
Enforcement Without a Judgment and the Request
Ordinary non-judgment attachment proceedings generally concern monetary and security claims (İİK m.42). The prohibition concerning matters within administrative jurisdiction and special rules for secured claims must be observed. Venue follows m.50, with the debtor's residence as the general rule. Special routes, including non-judgment eviction and negotiable-instrument enforcement, have their own conditions.
Upon the request the enforcement office serves a payment order on the debtor. If the debtor does not object within seven days from service, the proceedings become final; otherwise the creditor must take a further legal step to overcome the objection.
The request must clearly state the basis of the claim, its amount, the starting date of interest and the type of interest. Vague or contradictory requests can cause evidentiary difficulties at the later stage of removal or annulment of objection.
Enforcement Based on a Judgment and Its Conditions
Enforcement based on a judgment is available for claims supported by a court judgment or documents deemed equivalent to a judgment (notarised deeds containing an unconditional debt acknowledgement, arbitral awards, etc.). The debtor is served an enforcement order with a seven-day period; objection does not stay enforcement.
The debtor's defences in enforcement based on a judgment are limited. However, the grounds for staying enforcement under İİK m.33 — settlement (itfa), grace (imhal) or limitation (zamanaşımı) — may be invoked if supported by documents.
Competent Enforcement Office
In ordinary attachment proceedings, the debtor's residence is the general venue; the place of contractual performance may also qualify. A venue objection must accompany a timely objection to the payment order. By contrast, under İİK m.34 enforcement of a judgment may be requested from any enforcement office. The venue rules for these two routes therefore differ.
Practical Considerations
In enforcement and bankruptcy proceedings, the choice of enforcement track must be determined by the basis of the claim and the available documents. Although ordinary enforcement, commercial-paper enforcement, judgment-based enforcement, preliminary attachment, composition with creditors and bankruptcy may pursue the same outcome, they differ in time limits, available objections and costs.
Dates of service, objection or payment deadlines, attachment requests, sale-request periods and complaint deadlines are the most critical stages of the file. For this reason the dates of service of the payment order, enforcement order, attachment record, valuation report and sale notice should be tracked in a separate schedule.
For the creditor, interest calculation, the clarity of the enforcement request and the inquiry into the debtor's assets are decisive; for the debtor, grounds of objection, claims of exempt assets and the possibility of a negative declaratory action must be assessed from the outset. Otherwise, a procedural oversight may eclipse a meritorious position.
Statutory Provisions
The Turkish version of this page provides the relevant statutory texts or selected excerpts in Turkish. For the current consolidated legislation, our primary reference is mevzuat.gov.tr ; the Official Gazette and relevant court decisions should also be consulted for amendments, commencement and annulment provisions.
Conclusion
The choice of enforcement route should be made on the basis of the nature of the claim and the documents available. To avoid lost time and jurisdictional disputes, the enforcement request, interest calculation and service addresses should be checked carefully from the outset.
